Legal exploits may emerge at scale
Legal systems encode the foundations of social order in natural language. Similar to computer systems, the written law can contain vulnerabilities that invite exploitation.1 Courts absorb most exploits through interpretation, and such vulnerabilities rarely surface in the first place. With highly capable AI systems enabling the discovery of vulnerabilities at unprecedented scale, we believe the latter could change.
In testing this hypothesis, we have identified a substantial number of vulnerabilities in the German legal system using LLMs. To our knowledge, none of these have been previously recorded. We share a selection of vulnerabilities below, and present potential exploits for each. We share only those vulnerabilities whose exploitation we believe would not cause serious harm.
We believe that with cheap legal reasoning proliferating, AI systems could jeopardize the functioning of today’s legal systems. In such a world, lawmakers would need to significantly harden the process of legislation, for example by leveraging advanced AI themselves.
Case Study: German regulations
Sometimes, parliaments lack the capacity or subject-matter expertise to set out every detail in a statute.2 One way to address this is to pass a statute that authorizes the executive3 to regulate such details. The rules the executive issues under that authority are called regulations.4
To help ensure that the executive does not exceed these delegated powers, Article 80(1), sentence 3 of the German constitution requires each regulation to cite its legal basis. This legal basis usually consists of one or more5 statutory provisions authorizing the executive.6 Provisions in the regulation that are not covered by the cited legal basis are void.7
Using LLMs, we have identified regulations containing such void provisions. We present three examples below.
Case 1: Access to confidential documents
In brief: A rule that makes certain documents confidential may be void because the government failed to cite the legal basis it needed to make that rule.
On July 16, 2026, the Occupational Diseases Regulation was amended to include the provision below:

Occupational diseases are diseases designated as such by the Federal Government by regulation with the consent of the Bundesrat and contracted by insured persons as a result of an activity giving rise to insurance coverage under § 2, 3 or 6. The Federal Government is authorized to designate in the regulation as occupational diseases those diseases which, according to medical scientific knowledge, are caused by particular exposures to which certain groups of persons are exposed to a substantially greater degree than the general population as a result of their insured activity; it may provide that diseases qualify as occupational diseases only if caused by activities in particular hazardous areas. The regulation may also determine to what extent insured persons in maritime enterprises remain insured against occupational diseases while on shore leave.
[…]
(2) Accident insurance institutions must recognize a disease not designated in the regulation, or for which the conditions specified there are not met, as an insured event in the same manner as an occupational disease if, at the time of the decision, new medical scientific knowledge establishes that the conditions for designation under subsection 1 sentence 2 are met.
(2a) Diseases that arose in insured persons before their designation as occupational diseases are to be recognized retrospectively no earlier than
1. in cases under subsection 1, the date on which their designation as occupational diseases entered into force,
2. in cases under subsection 2, the date on which new medical scientific knowledge established that the conditions for designation under subsection 1 sentence 2 were met; where the Medical Expert Advisory Council on Occupational Diseases has adopted a recommendation to designate a new occupational disease, the date of adoption is decisive for recognition.
(3) If insured persons contract an occupational disease designated in the regulation under subsection 1, to the risk of which they were particularly exposed owing to the specific conditions of their insured activity, and no indications of causation outside that activity can be established, the disease is presumed to have been caused by the insured activity.
(3a) The accident insurance institution takes all evidence necessary to establish the facts. In addition to the evidence referred to in § 21 subsection 1 sentence 1 of Book X, it must take account of findings obtained by itself or another accident insurance institution at comparable workplaces or in comparable activities. This applies in particular where establishing exposures during the insured activity is difficult because the workplace no longer exists or has been altered. Accident insurance institutions should, individually or jointly, establish exposure registers relating to particular activities. These may be based on findings from systematic surveys, investigations in individual cases and research projects. Accident insurance institutions may also conduct investigations at comparable workplaces.
(4) Where insured persons with a recognized occupational disease face a risk that continued performance of the hazardous activity will cause the disease to recur or worsen, and that risk cannot be averted by other suitable means, accident insurance institutions must seek to ensure that they cease the hazardous activity. Accident insurance institutions must provide insured persons with comprehensive information about the risks associated with the activity and possible protective measures. To prevent a risk under sentence 1, insured persons must participate in measures aimed at prevention in the individual case and cooperate with measures aimed at prevention through behavior; §§ 60 to 65a of Book I apply accordingly. Obligations of employers and insured persons under Chapter Two and under occupational safety and health legislation remain unaffected. If insured persons fail to comply with their participation or cooperation duties under sentence 3, accident insurance institutions may, until compliance, refuse all or part of participation benefits, a pension for reduced earning capacity first payable after that failure, or the share of a pension corresponding to a subsequent substantial change in reduced earning capacity within the meaning of § 73 subsection 3. This requires that the failure to participate or cooperate has made participation benefits necessary or caused the reduction in earning capacity or the substantial change; § 66 subsection 3 and § 67 of Book I apply accordingly.
(5) Where provisions on benefits refer to the time of the insured event, occupational diseases are assessed by reference to the onset of incapacity for work or the need for treatment or, if more favorable to the insured person, the onset of a reduction in earning capacity entitling them to a pension.
(6) The Federal Government regulates by regulation with the consent of the Bundesrat
1. the conditions, nature and extent of benefits to prevent the onset, worsening or recurrence of occupational diseases,
2. the involvement of the bodies responsible for occupational medical protection in determining occupational diseases and diseases compensable under subsection 2 as occupational diseases; provision may be made to authorize those bodies to prepare expert opinions on causation and, in preparing them, to examine insured persons or have them examined by other doctors at the expense of the accident insurance institutions,
3. the fees payable by accident insurance institutions for the activities of the bodies under point 2; those fees are based on the effort required for the assessment and the resulting costs.
(7) Accident insurance institutions must inform the body responsible for occupational medical protection of the outcome of occupational disease proceedings where their decision differs from that body's expert opinion.
(8) Accident insurance institutions contribute to obtaining new medical scientific knowledge, in particular to the further development of occupational disease law; through their own research or participation in external research projects, they should help clarify the causal relationship between the incidence of disease in a particular group and harmful exposures in the course of insured activity. The associations of accident insurance institutions publish an annual joint report on their research activities and those of their member institutions. The report covers research topics, funds expended, and recipients of grants and external research contracts.
(9) To determine occupational diseases and diseases compensable under subsection 2 as occupational diseases, the bodies responsible for occupational medical protection may process data and examine insured persons to prepare their opinions insofar as this is part of their involvement under subsection 6 point 2; they may transmit those data to the accident insurance institutions in particular. The data collected may also be stored, altered, used or otherwise processed to prevent occupational accidents, occupational diseases and work-related health hazards, and their processing may be restricted. Where the bodies referred to in sentence 1 engage other doctors to examine insured persons, data may be transmitted between those bodies and the doctors engaged insofar as permitted within the scope of the examination mandate.

Conclusion:§ 9 subsection 5 sentences 2 and 3 BKV are void:
The advisory materials of the Expert Advisory Council are confidential, with the exception of the documents referred to in sentence 1. They remain confidential after deliberations have concluded.
Potential exploit: A journalist investigates why Germany’s Medical Expert Advisory Council on Occupational Diseases declined to recommend recognizing certain cancers linked to long-term night work as occupational diseases. Its published closing report refers to an unpublished written statement submitted by the “Night Logistics Employers’ Association”. She seeks to obtain the statement.
The association refuses to share it. The Federal Ministry of Labour and Social Affairs (BMAS) also rejects her request under the Freedom of Information Act (IFG), citing the confidentiality rules expanded by the 2026 amending regulation. She challenges that restriction on the ground that the amending regulation failed to cite the required legal basis.8
Further details on this exploit
The Freedom of Information Act (IFG) generally grants access to official information, but § 3 point 4 preserves statutory confidentiality restrictions. In 2026, § 9(5) of the Occupational Diseases Regulation (BKV) was expanded from internally prepared advisory materials to cover external statements as well. This is the restriction the Ministry invokes to withhold the association’s statement. As shown above, this amendment is void. It therefore cannot justify withholding this statement.
Potential follow-up considerations
§ 9(1a) SGB VII is not a legal basis, but only explains the scope of the legal basis set out in § 9(1). It therefore does not need to be cited.
Highly unlikely: Even the Federal Government itself expressly identifies § 9(1a) as the legal basis for a set of matters it lists in the explanatory memorandum to its bill.9 Among these matters, it lists the conduct of deliberations and publication of results.
If the amendment is void, the previous rule still bars access to the association’s statement.
Highly unlikely: The previous rule only protected internally created advisory documents. The association’s statement was created externally. Using it in the council’s deliberations does not turn it into an internally created document. The 2026 amendment amended the wording specifically to ensure that external statements are not outside its scope.10
Members’ duties of confidentiality and non-public meetings already bar access.
Highly unlikely: § 8 subsection 3 and § 9 subsection 1 sentence 3 BKV govern members’ confidentiality duties and exclude the public from meetings. However, these protections should not be read as barring access to an independently prepared external statement merely because the council considered it. The journalist requests the association’s original arguments without annotations revealing the council’s internal assessments. Case law concerning an external statement submitted to another confidential committee supports that distinction.11
Case 2: Airport transit without a visa
In brief: A rule requiring some travelers to obtain a transit visa may be invalid because the government failed to identify the legal power it needed to impose that requirement.

Conclusion:The addition of Mali to Annex C AufenthV is void:
Potential exploit: A Malian national plans to fly between two non-Schengen countries via Frankfurt, remaining entirely within the international transit area. She holds no document that already exempts her from the transit visa requirement. If the addition of Mali to Annex C to the Residence Regulation is invalid and no independent obligation applies, she could avoid the additional visa procedure and its cost.
No. The cited powers concern residence-title exemptions, procedures, fees, documents and register data. The separate power to designate countries subject to an airport transit visa requirement is § 99(3a) AufenthG; it is not covered by the preamble’s citation of other subsections and points. No. The previous Annex C listed neither Mali nor South Sudan.12 No. A notification to the Commission does not replace the regulation required by § 99(3a) AufenthG. No. The amending acts of 2023 and 2026 add Cuba and remove India, respectively. They neither replace the entire annex nor reenact the entries for Mali and South Sudan. Their correct citation of statutory authority therefore does not, by itself, cure the citation defect in the 2015 amendment.13 No. Neither Mali nor South Sudan appears in Annex IV to the Visa Code, which lists the countries whose nationals are subject to the common EU airport transit visa requirement.14Potential follow-up considerations
The visa requirement is covered by other cited legal bases.
If the amendment is void, the previous rule still requires the visa.
Germany had already notified the Commission of the requirement under Article 3(2) of the EU Visa Code (Regulation (EC) No 810/2009), so the visa requirement applies independently of Annex C.
Subsequent amendments to Annex C confirmed the disputed entries.
EU law independently requires the visa.
Case 3: Enforceable leave rights for soldiers at NATO’s JSEC
In brief: A rule denying some soldiers time off for overtime may be invalid because the ministry failed to identify the legal basis it needed to exclude them from that protection.
On March 6, 2025, the Soldiers’ Working Time Regulation was amended to add JSEC to the list below:

Conclusion:The addition of JSEC as No. 27 of the SAZV annex is void:
Potential exploit: A captain is assigned to NATO's Headquarters Joint Support and Enabling Command (JSEC) in Germany. He continues to serve within the remit of the Federal Ministry of Defence. He performs ordinary administrative staff duties outside the special activities covered by § 30c(4) Soldiers Act (SG). He requests compensatory time off for ten hours of officially ordered overtime in one month; no compelling service reasons prevent it. His unit refuses solely because the amended regulation excludes soldiers assigned to JSEC from entitlement to compensatory time off. If that exclusion is invalid, the captain can claim corresponding time off for the ten hours.
Further details on this exploit
Soldiers serving within the remit of the Federal Ministry of Defence generally benefit from the working-time protections in § 30c(1) to (3) of the Soldiers Act (Soldatengesetz, SG). Under § 30c(2) SG, ordered or approved overtime exceeding five hours in a month generally gives rise to an entitlement to corresponding time off for all of that overtime. However, the Act authorizes the Ministry to exempt soldiers serving at military establishments that bring together elements of several states’ armed forces. Section 1(2) of the Soldiers’ Working Time Regulation (SAZV) applies this exemption to soldiers transferred or assigned to an establishment listed in its annex to perform international or supranational tasks.15
JSEC is such an establishment. The SAZV was amended as described above to list JSEC as No. 27. Through § 1(2) SAZV, this listing exempts the soldiers concerned from § 30c(1) to (3) SG. Yet the preamble fails to cite the necessary legal basis, § 30c(6) in conjunction with § 93(2), point 7 SG. On the assessment advanced here, the exemption is therefore invalid, and § 30c(1) to (3) SG remain applicable.16
Potential follow-up considerations
The exemption is covered by other cited legal bases.
No. Section 30c(5), sentence 1, point 2 SG authorizes protective measures during special activities, not the exemption of additional groups from working-time rules. Section 30d SG permits a higher working-time limit for certain aircraft and ship crew duties, but expressly leaves § 30c(1) to (3) unaffected.17
If the new rule is void, JSEC remains exempt under the predecessor rule.
No. The previous annex did not cover JSEC.18
Earlier citations of statutory authority suffice for a limited amendment to the list.
Highly unlikely. As a rule, a regulation must cite every statutory power it exercises.19 The Higher Administrative Court of North Rhine-Westphalia exceptionally accepted the citation in the original regulation under state constitutional law. The limited amendments, including a reduction in a maintenance allowance to 85% of the reference amount, made sense only when read alongside the existing rules. Readers therefore had to consult the original regulation anyway, and its preamble contained the required citation.20 The Federal Administrative Court left that reasoning undisturbed within its limited scope of review; it did not establish a general exception to the federal citation requirement.21 We do not consider that reasoning applicable here: adding JSEC extends the working-time exemption to a new group of soldiers. Moreover, the original SAZV preamble cites only § 30c(5) in conjunction with what was then § 93(2), point 5 SG, not the exemption power in § 30c(6).22
